1. Acceptance of Terms

Welcome to StealthBets ("StealthBets", "we", "our", or "Service"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and the operator of StealthBets governing your access to and use of the StealthBets website, platform, and services (collectively, the "Service").

By accessing, registering for, or using the Service in any manner, you:

  • Acknowledge that you have read, understood, and agree to be bound by these Terms.
  • Represent that you are at least 18 years old and have the legal capacity to enter into this agreement in your jurisdiction.
  • Confirm that your use of the Service complies with all applicable laws in your country of residence, including those related to online gambling, data privacy, and financial activities.
If you do not agree to these Terms, you must not access or use the Service.

2. Description of Service

StealthBets is a Software-as-a-Service (SaaS) platform that provides users with tools to:

  • Log and track personal betting activities across various betting platforms.
  • Store and organize betting data (e.g., events, stakes, odds, outcomes) in a personal dashboard.
  • View basic analytics and statistics derived from their own logged betting history.
  • Optionally generate advanced analytical reports using artificial intelligence ("AI Analysis Feature").

Important Clarifications:

  • StealthBets is NOT a gambling operator, bookmaker, betting exchange, or financial advisor.
  • We do not accept wagers, process bets, or handle gambling funds.
  • The Service is a personal tracking and analytical tool only. All betting data is manually input or authorized by you.
  • The AI Analysis Feature utilizes third-party AI services (OpenAI) to process anonymized betting data you choose to submit.

3. User Account and Registration

3.1 Account Creation

  • To use the Service, you must create an account using Google OAuth authentication.
  • You must provide accurate, current, and complete information during registration and keep it updated.
  • You are responsible for safeguarding your account credentials and for all activities under your account.
  • You must notify us immediately of any unauthorized access or security breach.

3.2 Account Suspension/Termination

We reserve the right to suspend or terminate your account at our sole discretion if:

  • You violate these Terms or applicable laws.
  • We suspect fraudulent, abusive, or illegal activity.
  • Your use poses a security risk or could harm the Service, other users, or third parties.

4. User Responsibilities and Acceptable Use

4.1 Lawful Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You represent and warrant that:

  • Your use of the Service, including logging of betting activities, complies with all local, national, and international laws regarding gambling, data protection, and online conduct in your jurisdiction.
  • You are solely responsible for ensuring that tracking your betting activities and using analytical tools is legal where you reside.

4.2 Prohibited Conduct

You agree NOT to:

  • Use the Service if you are under 18 or the legal age for gambling in your jurisdiction.
  • Input, upload, or share data that is illegal, obscene, threatening, defamatory, or infringes intellectual property rights.
  • Use the Service to promote, facilitate, or engage in illegal gambling or financial activities.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated systems (bots, scrapers) to access the Service or extract data.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Misrepresent your identity or provide false betting data.

4.3 Data Input Responsibility

  • You are solely responsible for the accuracy, legality, and completeness of all betting data you enter.
  • You acknowledge that analytical outputs (including AI-generated reports) are based on your input data; "garbage in, garbage out."

5. AI Analysis Feature

5.1 Consent and Process

  • The AI Analysis Feature is optional. By using it, you automatically consent and authorize us to send anonymized betting data (stripped of your personal identifiers) to OpenAI (ChatGPT) for processing.
  • You acknowledge that OpenAI operates under its own privacy policy and terms.

5.2 No Guarantees or Advice

  • AI-generated reports are for informational and entertainment purposes only.
  • They do NOT constitute gambling advice, financial advice, predictions, or recommendations.
  • We do not guarantee the accuracy, usefulness, completeness, or timeliness of AI-generated content.
  • You are solely responsible for any decisions or actions you take based on the Service's analytics.

6. Payment and Credits

6.1 Freemium model

  • The Service may offer limited functionality for free ("Free Tier"). Extended usage requires the purchase of "Credits."
  • Credit packages are priced as displayed, inclusive of applicable VAT/taxes.
  • All payments are processed securely by third-party payment providers (e.g., Stripe, PayPal).

6.2 Purchase Terms

  • Credits are non-transferable, non-refundable, and have no cash value.
  • We reserve the right to modify Credit prices, packages, or the free tier limits at any time, with reasonable notice to existing users.
  • Credits are stackable and do not have an expiration date.

6.3 No Right of Withdrawal for Digital Content

  • By purchasing Credits, you expressly agree that we will begin providing the digital service immediately.
  • You acknowledge that you thereby LOSE YOUR RIGHT OF WITHDRAWAL under EU consumer protection law for the supply of digital content not supplied on a tangible medium. No refunds will be given for purchased Credits, except as required by law.

7. Intellectual Property

7.1 Our Ownership

  • StealthBets, its software, design and all content we create are our exclusive property or licensed to us.
  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

7.2 Your Data

  • You retain ownership of the personal betting data you input.
  • By using the Service, you grant us a worldwide, royalty-free license to store, process, and technically manipulate your data solely to provide and improve the Service, including anonymizing and transmitting it to AI providers for the AI Analysis Feature you request.

7.3 AI Outputs

  • AI-generated reports based on your data are provided to you for personal use.
  • Due to the nature of AI, similar outputs may be generated for other users.

8. Disclaimers and Limitation of Liability

8.1 Service "AS IS"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.2 No Liability for Gambling Losses

IN NO EVENT SHALL STEALTHBETS, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • YOUR GAMBLING ACTIVITIES, LOSSES, OR FINANCIAL DECISIONS.
  • YOUR RELIANCE ON ANALYTICS, STATISTICS, OR AI-GENERATED REPORTS FROM THE SERVICE.
  • THE ACCURACY, COMPLETENESS, OR TIMELINESS OF YOUR DATA OR OUR ANALYTICS.

8.3. Limitation of Liability

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL BE LIMITED TO THE AMOUNT YOU HAVE PAID TO US IN THE LAST 12 MONTHS.

8.4. Responsible Gambling Warning

GAMBLING INVOLVES RISK. PLEASE GAMBLE RESPONSIBLY. THE SERVICE IS A NEUTRAL TOOL AND DOES NOT ENCOURAGE OR DISCOURAGE GAMBLING. IF YOU BELIEVE YOU HAVE A GAMBLING PROBLEM, SEEK HELP FROM PROFESSIONAL ORGANIZATIONS (e.g., GamCare, Gamblers Anonymous).

9. Privacy and Data Protection

Your privacy is paramount. Our collection, use, and disclosure of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference. You consent to our data practices as described therein, including the international transfer of anonymized data for AI processing.

10. Termination

  • You may delete your account and terminate these Terms at any time.
  • We may suspend or terminate your access for breach of these Terms, with or without notice.
  • Upon termination, your right to use the Service ceases immediately. We may, but are not obligated to, delete your data after a reasonable period.

11. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Italy. You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and StealthBets as a result of your use of these services. You agree not to hold yourself out as a representative, agent or employee of StealthBets. You agree that StealthBets will not be liable by reason of any representation, act or omission to act by you.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent notice within the Service at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance of the new Terms.

13. Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain valid.
  • Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
  • Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and StealthBets regarding the Service.
